The petitioner herein applied for a writ of habeas corpus, alleging that he was unlawfully imprisoned, confined, and restrained of his liberty by the warden of Folsom state prison. The facts out of which such alleged illegal confinement and detention arose are the following: In the early part of the year 1921 the petitioner was indicted by a federal grand jury in and for the southern district of California upon the charge of having unlawfully entered the United States from Mexico without a passport, which offense was made a crime under the federal laws and regulations then in force.
