MEMORANDUM AND ORDER

LUNGSTRUM, District Judge.

This matter is currently before the court on the motion of defendant Employer Health Services, Inc., for a protective order (Doc. #58). Counsel for plaintiff John E. Aiken currently intends to interview various former employees of the defendant ex parte in an attempt to gather evidence in support of his claims. Defendant contends that these interviews would amount to a violation of the rules governing attorney conduct and that these witnesses instead should be formally deposed.
