KENNEDY, Circuit Judge.
Defendant-Appellant Richard Convertino appeals the district court’s partial denial of his motion to dismiss for failure to state a claim in this civil action filed against him by Plaintiff-Appellee Karim Koubriti. Koubriti seeks monetary damages from Convertino, pursuant to Bivens v. Six Unknown Named Agents of Federal Bureau of Narcotics, 403 U.S. 388, 91 S.Ct. 1999, 29 L.Ed.2d 619 (1971), for constitutional violations that Convertino allegedly committed while serving as the Assistant United States Attorney who prosecuted Koubriti for conspiracy to provide…
