This is an appeal by the state from a judgment in the respondent’s favor on the issues joined in quo warranto proceedings.

In January, 1909, the Lincoln Traction Company and the Citizens’ Railway Company, corporations, were separately operating lines of street railway in the city of Lincoln. The traction company also controlled a heat, light and power plant within that city.' At this time the Citizens’ Railway Company had outstanding $415,000 capital stock, which the railway commission subsequently found represented the investment of money and services of the reasonable value of $399,000.
