Defendant was convicted of first degree murder under RCW 9A.32.030(l)(b) for the death of his stepdaughter, Tanya Graff.

According to defendant's testimony, on the evening of June 24, 1977, Tanya, about 2 years of age, fell from her high chair. The following morning, defendant remained at home with his two stepchildren while his wife went to work at a beauty salon owned by defendant's cousin.
