On May 2, 1908, Patterson as receiver in bankruptcy of the Newcomer-Manry Company, under authority from tbe *702court of bankruptcy, instituted a suit in the city court of Atlanta against the Southern Construction Company, and caused summons of garnishment to issue and be served on the Fourth National Bank of Atlanta. The garnishee had funds of the defendant in its hands.
