Action for specific performance by plaintiff against the executor of his father’s will on three counts. The first count alleges that, in consideration that plaintiff and his wife would come and live with the deceased, defendant’s testator, and care for him the remainder of his life, pay his debts and furnish him necessary food, clothing and spending money, plaintiff might take immediate possession of deceased’s land, farm same, retain the proceeds, and that the deceased would give plaintiff the farm; that plaintiff paid certain sums, and cared for deceased in reliance on the oral contract.…
