THIS MATTER comes before the Court on: (i) the Plaintiffs’ Motion to Remand and Memorandum in Support Thereof, filed September 9, 2010 (Doc. 19)(“Motion to Remand”); and (ii) the Plaintiff and Plaintiff-Intervenors’ Motion Requesting That this Matter Be Returned to the Previously Assigned Judge, filed October 10, 2010 (Doc. 32)(“Motion to Return”).
