This is an action under St. 1906, c. 463, Part I, § 63, to recover damages for the death of the plaintiff’s intestate, while a passenger. A reasonable inference was possible from one aspect of the evidence that the plaintiff’s intestate, leaving his seat in a moving train of the defendant upon which he was *555a passenger, went on the lower step of a car, and, while the train was still in motion, was thrown off the step and killed through the suction created by a train passing at a high rate of speed on the next track.
