This is an action of tort to recover for the plaintiff’s personal injuries received as the natural result of *409sliding down a diving chute situated upon a raft in an arm of the sea adjacent to Fort Phoenix Park in Fairhaven.
The declaration is in three counts, the second of which is now waived.
