MEMORANDUM DECISION and ORDER

PARKER, District Judge.

This action for violations of the Americans with Disabilities Act (“ADA”), 42 U.S.C. §§ 12111-12117, and the New York State Executive Law § 296 is before this Court on defendant’s motion to dismiss the amended complaint for failure to state a claim pursuant to Rule 12 of the Federal Rules of Civil Procedure. In a Memorandum Order and Decision, dated December 22, 1995, this Court granted defendant’s previous motion to dismiss the complaint on the grounds that plaintiff had not alleged facts supporting his claim that he was discriminated…
