Affirming.
Tbe appellant, Robert F. McDermott, was a member of tbe National Guards wbicb were sent by tbe government to the Mexican border in 1916. Tbe returning troops left tbe border in October and were carried by a train of tbe appellee company by way of New Orleans, Mobile and *23Atlanta, to the north. Fourteen passenger coaches, a baggage car and a box car made up the train, which was used exclusively for the carrying of these troops.
