Antwan L. Ash (“defendant”) was tried before a jury at the 11 June 2007 Criminal Session of Brunswick County Superior Court after being charged with one count of first-degree murder and one count of robbery with a dangerous weapon. The State’s evidence tended to show the following: In two videotaped interviews, 1 which took place on 31 October 2005 and 1 November 2005, defendant told law enforce ment that on 28 October 2005, defendant, who was sixteen years of age at the time, contacted the victim, Kendrick Lamar Sparrow, also called Burger (“Burger”), to buy drugs.…
