1Opinion of the CourtBelt, J.
Defendant, who operates a store at Fossil, Oregon, and who is not a druggist, was convicted in the justice’s court of the crime of selling a package of aspirin tablets without having obtained a permit or license from the state hoard of pharmacy. It is stipulated that the defendant sold a “simple household remedy commonly known as aspirin in the original and unbroken package ’ ’ — same being " a simple 5-grain aspirin”. On appeal to the circuit court the judgment was upheld and now defendant appeals to this court.
