MEMORANDUM OPINION
ROY, District Judge.
This case initially involved an action filed on January 18, 1980, by Bankers Trust Company (“Bankers Trust” or “Bankers”), a New York bank, against Worldwide Transportation Services, Inc. (“Worldwide”), for restitution in the amount of $299,700.00.
