This cause is before the court on the appeal of complainant from the decree of the chancellor sustaining defendant’s demurrer to the original bill and dismissing the same.

Complainant averred in its bill, in substance, that defendant, on September 25, 1934, recovered a judgment against it, in the circuit court of Roane county, in the sum of $6,000; that complainant presented its motion for a new trial, which was overruled, and 30- days was allowed, from October 5, 1934, within which to file an appeal bond and a bill of exceptions, and otherwise perfected its…
