This suit was brought in the Circuit Court of Shelby County by the plaintiff A. E. Byrnes, defendant in error against the defendant Lumber Company, in which a judgment was rendered in his favor. The case was tried by Honorable Frank H. Gailor, Judge of Part II of said court, without the intervention of a jury. On May 14, 1943, the defendant filed a motion for new trial which was overruled. An exception was taken and defendant prayed and was granted an appeal to the Court of Appeals and thirty days allowed tó file a bill of exceptions and otherwise perfect the appeal.
