MEMORANDUM OPINION
LAMBERTH, District Judge.
This matter comes before the Court on the Motion [74] for Summary Judgment by plaintiff-relator K & R Limited Partnership (“K & R”) and the Motion [75] for Summary Judgment by defendant Massachusetts Housing Finance Agency (“MHFA”).
