PHILLIPS, Circuit Judge.

The Bratts brought this action against the Western Air Lines, Inc., 1 to recover damages for the alleged wrongful death of their father, Jack Raymond Bratt, who was a passenger on an airplane owned and operated by Western, and who was killed in the crash of the plane during a regularly scheduled flight from Salt Lake City to Los Angeles on December IS, 1942.

From an adverse judgment the Bratts have appealed.
