This is an action to recover damages for injury to personal property on the alleged ground of negligence.

The evidence showed that the plaintiff conducted a shop, in which was kept a stock of ladies’ wearing apparel in a room on the ground floor of a certain building in Salt Lake City. The' defendants conducted a hotel in rooms on the second and third floors of the same building. Both parties to the action were tenants of the same landlord.
