Appeal by the plaintiffs, Sidney Norman and others, from a judgment of the Supreme Court in favor of the defendants, entered in the office of the clerk of the county of New York on the 23d day of July, 1914, dismissing the complaint upon the merits on the decision of the court after a trial at the New York Special Term.

The plaintiffs, as stockholders of the Federal Mining and Smelting Company (hereinafter referred to as the Federal Company), have brought this action to set aside a contract dated October 16, 1905, entered into between said Federal Company and the American Smelting and Refining Company (hereinafter referred to as the Smelting Company), whereby the Federal Company sold to the Smelting Company all the lead-silver ores, slimes and concentrates that might be produced from its properties, for a period of twenty-one years from August 31, 1909.
