MEMORANDUM
MORTON, Chief Judge.
Petitioner, Billy L. Summers, has filed a petition for a writ of habeas corpus, pursuant to 28 U.S.C. § 2254, alleging that he was unconstitutionally denied the effective representation of counsel on the appeal of his state court conviction. Respondent denies that petitioner’s constitutional rights to representation by counsel on appeal were violated, contending that petitioner’s uncooperativeness caused him not to be represented by retained counsel on appeal and that the State of Tennessee was under no obligation to secure appointment of counsel for petitioner.…
