This matter comes before the Court on the motion of Alan P. Halpert (“Alan Hal-pert” or “Defendant”) for entry of an order pursuant to Federal Rule of Civil Procedure 12(b) made applicable to this case by Federal Rule of Bankruptcy Procedure 7012 to dismiss the causes of action as to Mr. Halpert of the Complaint by Charles M.
