Suit was filed in the district court of Erath county by Mrs. Clem Gresham and her husband, J. R. Gresham, against the Western Union Telegraph Company, to recover damages for mental anguish suffered by Mrs. Gresham as the result of a failure of defendant to promptly deliver a telegram sent from Stephenville to Mrs. Gresham at Burkburnett, announcing that her mother, Mrs. J. C. Murray, was very low, and requesting Mrs. Gresham to come if she wished. The telegram was sent by Marvin Sharp, nephew of Mrs. Gresham and grandson of Mrs. Murray.
