Appellee sued appellant for mental anguish damages resulting from the failure of appellant to deliver appellee a telegram notifying him of the death of his wife, thereby •depriving him of attending her funeral; and on a jury trial recovered judgment for $2,000; hence this appeal.

This is the second appeal of the case. On the former appeal (253 S. W. 565) a judgment for $2,800 in favor of appellee was affirmed by the Court'of Civil Appeals, but was reversed and the cause remanded (265 S. W. 381) by the Commission of Appeals, because of the failure of the trial court to submit a requested issue…
