This is an action for damages caused hy surface water flooding the basement of the plaintiff’s storeroom as a result, it is alleged, of the defendant’s negligent omission' to maintain in proper condition a system of drains, ditches and culverts, which it had constructed for the purpose of conducting the surface water through the city. This cause was reviewed by this court on a former occasion.
