Recovery is sought of the defendant company for damages alleged as resulting to plaintiff from injuries- received by him while an alleged employee of defendant, engaged on July 15, 1907, in the construction of an elevator at Ruso, in Ward county. The injuries were caused by a platform giving way and precipitating him from the top of the elevator 45 feet downward, inflicting upon him serious and probably permanent injuries, for which a jury has awarded plaintiff damages in the sum of $8,000.(1) In whose employ was plaintiff ?
