Warneke, the appellant, and the sheriff of Aiken County, from selling certain real estate, levied upon under the judgment in the case of H.F. Warneke, plaintiff, against D.H. Kearse and Susan Badger Kearse, defendants. The following facts were admitted by the parties to this controversy:
