The facts giving rise to the questions presented here for our determination are as follows: Mrs. P. A. Permenter, “ a childless widow,’’ died on the-■ day of April, 1924, leaving of force her last will and testament bearing date November 9, 1928, which was duly admitted to probate in common form in the probate Court for Edgefield county, on the 24th day of April, 1924.
