The plaintiff in error (hereafter called the defendant) was convicted in the municipal court of Milwaukee county of assault upon one Fred Seifert with intent to rob, being armed with a dangerous weapon, and was sentenced to imprisonment in the state prison therefor, and prosecutes this writ of error -to reverse the judgment.
