Duke Anderson Drilling Company obtained a judgment in the court of common pleas of Oklahoma county against one Smith and Highway Insurance Underwriters; but thereafter the trial court sustained the motion for judgment notwithstanding the verdict of Highway Insurance Underwriters and then sustained Smith’s plea to the venue of the action. Drilling Company appeals assigning one proposition combining the rulings just mentioned.
