Anthony Pagliaccetti (“Petitioner”) is a prisoner at the State Correctional Institution — Mahanoy in Frackville, Pennsylvania. Petitioner filed an application for a writ of habeas corpus pursuant to 28 U.S.C. § 2254 (“Habeas Petition”) challenging his custody. Magistrate Judge David R. Strawbridge recommended denial of the Habeas Petition without an eviden-tiary hearing.
