McMILLIAN, Presiding Judge.

Defendant Giccio Stephens appeals from a jury verdict finding him guilty of manslaughter and sentencing him to ten years imprisonment. We affirm the judgment for the reasons discussed below.

On October 29, 1974, defendant was arrested and charged with murder first degree of Danny Thomas. Defendant was convicted on October 16, 1975, of murder second degree and sentenced to twenty years imprisonment. Defendant then filed a motion for a new trial and that motion was sustained.
