This case is before this court on certification from the United States Court of Appeals for the Ninth Circuit pursuant to ORS 28.200 to 28.255. See Western Helicopter v. Rogerson Aircraft, 311 Or 361, 811 P2d 627 (1991) (setting out and explaining the certification process). The five questions certified are:
