These two cases tried together are here on plaintiff’s exception in each case to the direction of a verdict for defendant.

The actions arose from the negligent operation of the defendant’s automobile truck on October 12, 1925, by one of its employees, Palogelli. Plaintiff Marion, wife of plaintiff James, suffered injuries aiid James lost her services.

Defendant was engaged in the milk and cream business employing about one hundred and twenty people of whom Palogelli was ordinarily an inside man. He was never authorized or asked to drive the truck by defendant and in doing so was violating…
