TIBBS, District Judge:

On August 12, 1964, the appellant, Dudley M. Amoss, entered into a contract with respondents’ predecessor, Heber Bennion, and others, by the terms of which he was to purchase and they were to sell the Ben-nion Ranch, consisting of real and personal properties.

This is the fourth time this court has been called upon to settle differences in regards to the transaction and the problems arising out of it. The prior decisions are Amoss v.
