SAFFELS, District Judge.

This matter is before the court on defendant APAC-Kansas, Inc.’s motions for summary judgment on plaintiffs’ amended complaint and on defendant Board of County Commissioners’ cross-claim for indemnity. Although the facts of this case are uncomplicated and basically uncontroverted, the legal implications arising from the facts are complex and very much in controversy.
