The plaintiff, the estate of Lillian Janowicz, brought this action against the Massachusetts State Lottery Commission (“Commission”) to recover damages for the Commission’s failure to honor the terms of a prize award letter. The plaintiff asserts that the Commission’s actions constitute a breach of contract, or in the alternative, provide grounds for estoppel, and violate G.L.c. 93A. The Commission has moved to dismiss the plaintiffs complaint, pursuant to Mass.R.Civ.P. 12(b)(6), for failure to state a claim upon which relief may be granted.
