OPINION
BRETT, Judge:
Plaintiff in Error, James Edward Black-eter, hereafter referred to as defendant, was tried by a jury in the District Court, of Oklahoma County, Oklahoma, Case No. CRM-69-435, on the charge of Operating an Open Saloon; the jury returned a verdict of guilty and fixed defendant’s punishment at ninety (90) days in the County Jail and a fine of Five Hundred ($500.00) Dollars; judgment and sentence was accordingly entered by the court, from which defendant has perfected his appeal to this Court.
