Appellant, Pauline A. Patrick, commenced this action in the district court for Buffalo County against the appellee, The Union Central Life Insurance Company, a corporation. The purpose of the action is to recover on an insurance policy issued by the appellee on the life of Gomer C. Patrick. The basis of appellant’s claim is that the insured is dead because of the legal presumption of his death arising by reason of his continued and unexplained absence since shortly after October 2, 1938, which was more than seven years prior to the commencement of this action.
