I. INTRODUCTION

This matter comes before the Court on Defendants’ Motion to Dismiss [Docket No. 34]. On August 17, 2009, Plaintiffs filed their Second Amended Complaint (“SAC”) [Docket No. 29], alleging Racial Discrimination and Retaliation in violation of (1) the Minnesota Human Rights Act (“MHRA”), Minn.Stat. § 363A.01 et seq.; (2) the Minneapolis Civil Rights Ordinance (“MCRO”), Minneapolis, Minn., Code of Ordinances § 363A.01 et seq.; (3) 42 U.S.C. § 1981; and (4) Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq.…
