The plaintiff owned and operated a general store in his own building in Lincoln Valley, and sold his stock of goods to the defendant in the fore part of May 1934. They discussed the use of the building and lots and agreed on a monthly rental of $40.00 for six months. At the same time the plaintiff offered to sell the building to the defendant for $2,000.00 in monthly payments of $50.00, defendant claiming the offer included the fixtures.
