The action in this case was for specific performance of a contract to convey an interest in real estate. The contract between the parties was as follows:
“This agreement made and entered into by and between Philip Ware, for himself and as agent for his wife, Docie Ware, have this day in consideration of $975. sold the mineral rights on the following land to A. O.
