The question for adjudication which arises in this case grows out of the following state of facts. On the 23d *410day of August, 1882, McArthur by deed conveyed to Alford title to certain lots of land, viz., Nos. 27, 44, 61, 81, 141, 165, 205, 239, 327, 364 and 461, in the eighth district of Colquitt county, Georgia, in which deed of conveyance McArthur made, a general warranty of title. At the time of the conveyance McArthur was not, nor does it appear from the record that he ever was, in possession of the land conveyed.
