The parties may be referred to herein as plaintiff and defendant, according to their positions in the trial court, the latter term meaning Eeddick, who was the principal defendant, although several persons were named as defendants in the petition.

The general demurrer to count 1 was properly sustained. In this count the plaintiff sought relief as a bidder, claiming that it was entitled to have the property reoffered and the sale resumed at a certain point where the bidding was interrupted.
