MARSH, District Judge.

An indictment containing five counts was returned against the petitioner, Wilfred J. Brougher. They charged that he carried on the business of a distiller without having given bond; that he carried on said business with intent to defraud the United States of the tax upon twelve gallons of distilled spirits; that he had possession of an unregistered still and distilling apparatus; that he made and fermented 475 gallons of mash fit for distillation and production of spirits and alcohol in a building and on premises other than a duly authorized distillery; and that he…
