Monks, C. J.-
— Appellant was charged by indictment with the crime of murder in the first degree. A trial of said cause resulted in a verdict of murder in the second degree, and over a motion for a new trial final judgment was rendered thereon.
*293The errors assigned and not waived call in question the action of the court in overruling appellant’s motion for a new trial.
