The primary issue on this sentencing appeal by the Government is whether Apprendi v. New Jersey, 530 U.S. 466, 120 S.Ct. 2348, 147 L.Ed.2d 435 (2000), applies to enhancements, prescribed by the Sentencing Guidelines, that increase a defen dant’s sentence above the sentencing range applicable without the enhancements. If so, the facts supporting such enhancements would have to be charged in the indictment and found by the jury beyond a reasonable doubt.
