In this case involving claims of age and employment discrimination we must resolve several issues of first impression.

Julio Mercado-Garcia (“Mercado”) was fifty years old and had been in the employ of the Ponce Federal Bank (“the Bank”) for eleven years when he was discharged from his position as Vice President for Human Resources in 1988. The final year of his tenure had not apparently been pleasant.
