McFARLAND, Chief Justice:

Chester S. Howland, hereinafter referred to as defendant, was arrested on June 2, 1964, charged with kidnapping a minor child in violation of § 13-491, 5 A.R.S. (1956) (with prior conviction), and later released on bond. Then, on August 5, 1964, he was arrested again and charged with forcibly kidnapping a female child under fourteen years of age for the purposes of committing lewd and lascivious acts (with prior conviction), under § 13-492, 5 A.R.S.
